How do I Manage PST's and Email Content to comply with current eDiscovery requests? Routine email discovery requests are common within organizations today, however, complying with the electronic discovery phase of litigation can involve weeks of work by an IT department, a fact not widely understood by litigants. In of March 1995, Morgan Stanley's was issued a record-breaking $15 million fine from the SEC. This settlement with the SEC was over improper email retention practices. In another case Price Waterhouse Coopers was sued for improper audits of Telxon, a wholly owned subsidiary of Symbol Technologies. During the trial, PWC was only able to produce the requested messages after suspicious delays. The Judge issued a default ruling against PwC , citing its apparent "willfulness, bad faith or fault". After these delay's, it appeared that the messages had also been altered, leading the judge to suggest that the firm and their lawyers had "engaged in deliberate fraud." The judge recommended that PwC pay a fine of $345 million and the company finally settled for $18 million with Symbol Technologies and ended a class action suit by Talxon's investors by settling for $37 million.
